📃 Terms of Service

Welcome to ForestForay. These Terms of Service ("Terms") govern your use of ForestForay mobile applications and related services published by Amplified Ideas Consulting Inc. By downloading, installing, or using our applications, you agree to be bound by these Terms.

1. License Grant

We grant you a personal, non-exclusive, non-transferable, revocable license to use the ForestForay applications on devices you own or control, solely for personal, non-commercial purposes. You may not:

• Copy, modify, or distribute the application or its content.
• Reverse engineer, decompile, or attempt to extract the source code.
• Use the app for any unlawful purpose or in violation of any applicable laws.
• Resell, sublicense, or commercially exploit any aspect of the service.

2. Nature Identification Disclaimer

⚠️ Important Safety Warning: ForestForay uses artificial intelligence for species identification. AI identifications are probabilistic and may be incorrect. You must:

• Never consume any wild plant, mushroom, berry, or other organism based solely on an app identification.
• Always consult a qualified expert (mycologist, botanist, or experienced forager) before consuming or handling any wild species.
• Exercise caution around wildlife — maintain safe distances and follow local regulations.
• Supervise children at all times during outdoor activities.

ForestForay is an educational and entertainment tool. We are not liable for any injury, illness, or damage resulting from actions taken based on species identifications provided by the app.

3. Subscriptions & Payments

• Free Tier: Basic access with daily scan limits and standard features.
• Premium Subscription: Unlimited scans, advanced features, and an ad-free experience. Billed monthly or annually through the Apple App Store or Google Play Store.
• Auto-Renewal: Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.
• Cancellation: You may cancel your subscription at any time through your device's App Store or Play Store settings. Access continues until the end of the paid period.
• Refunds: Refund requests are handled by Apple or Google in accordance with their respective refund policies.

4. User Content & Sighting Data

• Sighting photos and data you submit may be used for biodiversity research purposes in aggregate, anonymized form.
• You retain ownership of photos taken with the app.
• By contributing sightings, you grant us a non-exclusive license to use the anonymous data for research and app improvement.

5. Children & COPPA

ForestForay Kids Mode is designed for children under 13 in compliance with the Children's Online Privacy Protection Act (COPPA). See our Kids Privacy Policy for details on how we protect children's information.

6. Acceptable Use

You agree not to:

• Use the app to harass, threaten, or harm others.
• Submit false or misleading sighting data intentionally.
• Attempt to gain unauthorized access to our systems or other users' data.
• Use automated tools (bots, scrapers) to interact with the app.

7. Limitation of Liability

To the maximum extent permitted by law, Amplified Ideas Consulting Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the application. Our total liability shall not exceed the amount you paid for the service in the twelve (12) months preceding the claim.

8. Termination

We reserve the right to suspend or terminate your access to the service at any time for violations of these Terms or for any other reason at our discretion. Upon termination, your license to use the app is immediately revoked.

9. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada. Any disputes arising from these Terms shall be resolved in the courts of British Columbia.

10. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the app constitutes acceptance of the updated Terms.
